Product Disclaimer & Limitation
of Liability
1. Nature of the Products
All products sold by Gail Marra Design Studio, including but not limited to original artworks, sculptural décor, mirrors, lighting features, and statement pieces are artistic and decorative in nature. They are not manufactured consumer goods and are not supplied as engineered, load-bearing, or safety certified installations unless explicitly stated in writing.
2. Material Characteristics & Variations
Due to the handmade, sculptural, and artistic nature of the work, variations in colour, texture, scale, finish, surface markings, and patina may occur. These characteristics are integral to the artwork and do not constitute faults, defects, or grounds for return.
Environmental exposure (including humidity, temperature changes, sunlight, coastal air, and handling) may affect the appearance of the work over time. Such changes are considered normal and expected.
3. Client Responsibility
The client assumes full responsibility for:

Determining the suitability of the artwork for its intended location and purpose

Ensuring correct handling, transportation, mounting, and installation

Engaging qualified professionals where required

Compliance with all applicable laws, building regulations, safety standards, and property requirements
Any advice provided by Gail Marra Design Studio is artistic in nature and does not constitute engineering, architectural, or safety advice.
4. Installation & Use
Unless expressly agreed in writing, installation is not included in the sale. Gail Marra Design Studio shall not be held responsible for installation errors, structural failure, surface damage, or any resulting injury or loss.
Products are intended for decorative use only and must not be altered, adapted, or used in a manner inconsistent with their artistic purpose.
Heavy & Large Scale Sculptural Pieces
This artwork is a heavy, large scale sculptural piece. Due to its weight, dimensions, and material composition, professional handling, transportation, and installation are required. The purchaser is solely responsible for assessing structural suitability, load-bearing capacity, anchoring methods, and site conditions.
Gail Marra Design Studio accepts no liability for structural failure, surface damage, injury, or loss resulting from improper handling, installation, or environmental conditions.
Lighting & Mirrors – Installation Disclaimer
Lighting features and mirrors are supplied as decorative design elements. Electrical connection, wall mounting, anchoring, and structural support must be carried out by suitably qualified professionals in accordance with all applicable regulations and standards.
Gail Marra Design Studio does not provide electrical, structural, or installation services unless expressly agreed in writing and shall not be held liable for damage, injury, malfunction, or loss arising from installation, wiring, mounting surfaces, or site conditions.
5. Limitation of Liability
To the fullest extent permitted under South African law:

Gail Marra Design Studio shall not be liable for any direct, indirect, incidental, consequential, or special damages, including but not limited to personal injury, property damage, loss of income, or third party claims

Liability, if any, shall be strictly limited to the purchase price of the product supplied
Nothing in this disclaimer limits any rights the consumer may have under the Consumer Protection Act, 68 of 2008, where applicable.
6. Risk & Transfer of Responsibility
Risk passes to the client upon collection or delivery of the product. From that point onward, the client assumes all responsibility for the artwork.
7. Acceptance of Terms
By purchasing, commissioning, or accepting delivery of any product, the client confirms that they have read, understood, and accepted this Product Disclaimer and Limitation of Liability in full.
