1. Orders & Payment

Orders are confirmed upon receipt of full payment.

We reserve the right to cancel any order due to:

• Pricing or typographical errors

• Stock unavailability

• Suspected fraudulent activity

 

 

2. Stock Availability

All stock items are subject to availability and cannot be guaranteed until full payment has been received.

Items will be reserved for 24 hours following checkout. If payment is not received within this timeframe, the item will be released back into inventory. Availability and pricing cannot be guaranteed thereafter.

3. Handmade Nature of Work

Each piece is individually handcrafted. Subtle variations in colour, texture, scale, and finish are inherent to the artistic process and form part of the uniqueness of the work. These variations do not constitute defects.

Environmental conditions — including humidity, coastal air, sunlight exposure, and handling, may naturally influence materials over time.

4. Custom & Made to Order Pieces

Custom, personalised, and commissioned works are created specifically for the client and are non-refundable, unless defective in accordance with the Consumer Protection Act.

Production commences upon receipt of full payment.

 

 

5. Production Lead Times

Made-to-order pieces require a production period prior to dispatch. Estimated lead times are provided as a guideline and may vary depending on materials, complexity, and studio workflow.

 

 

6. Delivery & Risk

Delivery is facilitated through third-party courier services.

Risk transfers to the customer upon delivery and signed acceptance of the goods.

 

 

7. Installation Responsibility

Installation is not included unless expressly agreed in writing.

The client assumes responsibility for:

• Structural suitability of the installation site

• Appropriate mounting methods

• Engaging suitably qualified professionals where required

 

Professional installation is strongly recommended for heavy sculptural works, mirrors, and lighting pieces.

 

 

8. Digital Products

All digital downloads are licensed for personal use only.

Upon confirmation of payment, digital files are made available for immediate access. Due to the nature of digital products, all digital sales are final and non-refundable.

Please note:

• No physical product will be shipped.

• Files may not be shared, resold, reproduced, or redistributed in any format.

• Colour representation may vary depending on individual screen and printer settings.

9. Limitation of Liability

Liability is strictly limited to the purchase price of the item.

Gail Marra Design Studio shall not be liable for any indirect, incidental, or consequential damages.

Nothing in these Terms limits or excludes any rights afforded to consumers under the Consumer Protection Act.

 

 

10. Returns

All returns are governed by our Refund & Cancellation Policy.
